License Agreement for ‘Meteum’ mobile application
Before using the program, please, read the terms of the license agreement below.
Any use of the program means your full and unconditional acceptance of the terms of this license agreement.
If you disagree with any the terms of the license agreement in full, you may not use the program for any purposes.
1. General Terms
1.1. Tech Services LLC (hereinafter referred to as the Company) offers the User to exploit ‘Meteum’ mobile application (the Program) on the terms and conditions set out herein (the License).
1.2. By downloading the Program, installing it on User’s device or otherwise using it, the User is deemed to have expressed his full and unconditional agreement with the terms of the License.
1.3. Using the Program on conditions other than those provided herein shall not be allowed unless authorized in writing by the Company. If the User does not agree to any of the provisions of the License, such User shall immediately cease using the Program.
1.4. The Program is offered on the terms of this License free of charge, for personal non-commercial purpose.
1.5. The User’s personal data is stored and processed in compliance with the Privacy Policy published at https://docs.meteum.ai/en/pages/privacy.
1.6. The Company reserves the right, at its sole and absolute discretion, to change or modify provisions of the License at any time. Any such changes will become effective upon the publication of the new version at: https://docs.meteum.ai/en/pages/applicense.
2. Use of the Program
2.1. The Program allows the User to access the meteorological data, in particular, weather forecast, including information on air temperature, cloudiness, precipitation, pressure, air humidity, wind speed and direction.
2.2. Meteorological data can be provided by the Company partners. The accuracy, relevance and actuality within the certain territory of the meteorological data may vary. The Company shall not be liable for any User’s decisions made drawing on the information gained via the Program.
2.3. The User is hereby notified and agrees that the Program can access depersonalized data on the User’s location for getting more precise weather forecast (if the User did not refuse to provide such information in the Program settings). The User may withdraw such consent at any time.
3. License and Intellectual Property
3.1. The exclusive right to the Program is vested in the Company.
3.2. The Company or other intellectual property owners retain exclusive rights to the meteorological data and Program interface. The License does not give the User any claim to the Program or meteorological data other than stated in this License.
3.3. The Company grants the User a simple (non-exclusive), non-transferable license to use the Program by installing it on the User’s devise.
4. Restrictions
4.1. Some functions of the Program can only be performed with the Internet available. The User shall independently get and pay for such access under terms and as per tariffs of its communication or Internet provider.
4.2. Except as used in the scope and in the ways expressly stipulated by this License, the User may not modify, decompile, disassemble, decrypt and perform any other actions with the object code and source code of the Program meant to obtain information on the implementation of algorithms used in the Program, create derivative works using the Program and otherwise use (allow to use) the Program and any components thereof, maps and other images and data stored by the Program on the User’s mobile device, without the Company’s written consent.
4.3. The User may not reproduce and distribute the Program for commercial purposes (inter alia, for a fee), including, as a part of software product collections, without the Company’s written consent.
4.4. The User may not distribute the Program in any form or means other than the one received, without the Company’s written consent.
4.5. The Program is distributed and shall be used under the ‘Meteum’ name. The User may not change or delete the name of the Program, the copyright notice or other references to the Company.
5. Limitation of Liability
5.1. The Program (including meteorological data) is provided “as is”. The Company provides no warranties regarding error-free and uninterrupted operation of the Program or its components and functions, consistency of the Program with specific goals and expectations of the User, reliability, accuracy, completeness and actuality of the meteorological data, and provides no other warranties not expressly stated in this License.
5.2. To the fullest extent allowed by the applicable law, neither the Company nor its suppliers shall be liable for any direct or indirect consequences of any use or inability to use the Program, or damages caused to the User or third parties as a result of any use or inability to use the Program, including as a result of possible errors or failures.
5.3. The User is hereby notified and agrees that when the Program is used on a mobile device the following information will be automatically and anonymously transmitted to the Company: the type of the operating system on the User’s mobile device, the version of the Program and the Program ID, statistics on the use of functions of the Program, and other technical data.
6. Final Provisions
6.1. This License applies to all future updates or new versions of the Program. By installing an update or a new version of the Program, the User agrees to the terms of this License in respect to such updates or new versions of the Program unless a new license agreement is required.
6.2. The Company may change the terms of the License at any time without notice. The current version of the License is located at https://docs.meteum.ai/en/pages/applicense. New editions come into force after being published at the address above. The use of the Program upon such changes constitutes consent with the new terms of the License. The User must stop using the Program if he or she disagrees with new provisions of the License.
6.3. All issues and claims related to the use or inability to use the Program and possible violations of laws or third-party rights by the Program shall be sent through the feedback form to help@meteum.io.
